About these terms

These terms are between you and RK Technology Group Limited (“Tokeat”, “we”, “us”), a company registered in England and Wales with company number 17205820.

They apply when you use tokeat.com or a restaurant’s ordering website run on Tokeat. By creating an account or placing an order you agree to them. Our Privacy Notice explains how we use your data.

What Tokeat does, and who sells you the food

Tokeat provides the ordering platform. The restaurant you order from is the seller: your contract for the food, and for its delivery or collection, is with that restaurant, not with Tokeat. The restaurant sets its menu, prices, opening hours, delivery area and fees, prepares your order and is responsible for it.

The restaurant’s name is shown on its ordering website and on your order confirmation. Where it has its own terms, they apply to your order too.

Your account

  • You must be 18 or over to create an account or place an order.
  • Give accurate details and keep them up to date. We verify your phone number so the restaurant can reach you about your order.
  • Keep your sign-in details secure and do not share your account. Tell us straight away if you think someone else has used it.
  • You can delete your account at any time from your account page.

Placing an order

When you place an order you are making an offer to the restaurant. The contract is formed when the restaurant accepts your order. If the restaurant does not accept it, you are not charged, and any card payment taken is refunded or released.

Check your order, delivery address or table, and requested time before you place it. Times shown are estimates given by the restaurant.

Payment

You pay the restaurant, not Tokeat. Card payments are processed for the restaurant by our payment provider; card details are entered directly with it and never reach us. Some restaurants also accept cash, which you pay to the restaurant on collection, delivery or at the table.

Prices include VAT where the restaurant charges it. Any delivery fee or service charge is shown before you place your order.

Credits and discount codes are offered by restaurants, apply only where and when the restaurant says, have no cash value and cannot be transferred.

Cancellations, refunds and problems with your order

Because food is made to order and perishable, you cannot cancel an order once the restaurant has accepted it, except where the restaurant agrees. The 14-day cancellation right for distance purchases does not apply to food for immediate consumption.

If something is wrong with your order, contact the restaurant as soon as you can. Refunds are decided and given by the restaurant. This does not affect your legal rights: food must be as described, of satisfactory quality and fit for purpose.

If you cannot resolve a problem with the restaurant, or the problem is with Tokeat itself, email support@tokeat.com.

Allergies and dietary needs

Allergen and dietary information is provided by the restaurant, and the restaurant is responsible for it. If you have an allergy or intolerance, contact the restaurant before you order to check that a dish is safe for you. Kitchens handle many ingredients, and cross-contamination can happen.

Using Tokeat fairly

You must not:

  • place orders you do not intend to pay for or collect;
  • misuse credits, discounts or referral offers;
  • try to get into accounts or systems that are not yours, or disrupt the platform;
  • copy, scrape or resell content from Tokeat or restaurants’ websites; or
  • use Tokeat for anything unlawful, or to harass anyone, including restaurant staff.

We may suspend or close an account that breaks these terms.

Our responsibility to you

We provide the platform with reasonable care and skill. We do not promise that it will always be available or free of errors, and we are not responsible for the food, its preparation or delivery, which are the restaurant’s responsibility.

We are responsible for loss you suffer that is a foreseeable result of our breaking these terms or failing to use reasonable care. We are not responsible for loss that was not foreseeable, or for business losses.

Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else the law does not allow to be limited, and nothing affects your statutory rights as a consumer.

Complaints

Complaints about an order go to the restaurant. Complaints about Tokeat go to support@tokeat.com; we aim to reply within 5 working days.

Changes to these terms

We may update these terms, for example to reflect changes to the platform or the law. The version and date at the top show when they last changed. The terms in force when you place an order apply to that order.

Law and courts

These terms are governed by the law of England and Wales. You can bring proceedings in the courts of England and Wales, or, if you live in Scotland or Northern Ireland, in the courts where you live.
